User Guideline
This user guideline (this “Guideline”) applies to aptpod, Inc. (“Aptpod”) and the user (the “User”) of the web application products accompanying or related to the IoT platform “intdash” (collectively referred to as the “Software”) provided by Aptpod. By checking the acceptance box or using all or any portion of the Software, the User is considered to accept all the terms and conditions of this Guideline.
The User agrees that this Guideline, like any contract that the User has accepted by any form including signing, is enforceable for performance and are legally binding between Aptpod and the User. If the User does not agree to all of these terms and conditions, the User must not use the Software.
1. Prohibited Acts
In addition to what is set out elsewhere in this Guideline, the User shall not:
- infringe on the copyrights, trademark rights or any other intellectual property rights held by Aptpod or any third party in relation to the Software (including copying, adapting or otherwise using the copyright materials relating to the Software without Aptpod’s permission);
- obtain or apply for any patent right, utility model right or other intellectual property right based on or in relation to the Software without the prior consent of Aptpod;
- reverse engineer, decompile, disassemble or any otherwise analyze the Software;
- access or use, or attempt to access or use, any function of the Software that Aptpod has not licensed;
- violate any laws, rules or regulations, or violate any regulations or guideline set forth by Aptpod; or
- perform any act equivalent to any of the preceding items.
2. Compensation for damages
In the event that Aptpod suffers any damage as a result of the User’s conduct or violation of this Guideline, Aptpod may claim compensation from the User for any and all damages (including reasonable attorney’s fees).
3. Change of this Guideline
Aptpod reserves the right to change this Guideline at any time. In the event of any such change, Aptpod shall notify the User of such change through Aptpod’s website or in a manner separately determined by Aptpod. The User shall be deemed to have agreed to such change if the User uses the Software after such notification.
4. Language
The original version of this Guideline shall be the Japanese version only, regardless of whether this Guideline has been translated into any other languages.
5. Governing Law and Jurisdiction
This Guideline shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall be the exclusive court of the first instance for any and all disputes relating to this Guideline.
